IMPORTANT: Please read these Terms carefully before using the FindPlay Platform. By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
These Terms constitute a legally binding agreement. We recommend you print or save a copy for your records.
By accessing or using the FindPlay platform ("Platform"), including our website at www.findplay.com, mobile applications, APIs, and related services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions of Service ("Terms"). These Terms constitute a legally binding agreement between you and FindPlay Inc. (EIN: [Insert EIN]) ("FindPlay," "we," "us," or "our").
If you are accepting these Terms on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to bind that entity to these Terms, in which case "you" and "your" refer to that entity.
To use the Platform, you must:
Be at least 13 years of age (or the minimum legal age in your jurisdiction to consent to use online services)
If you are between 13 and the age of majority in your jurisdiction, have obtained parental or guardian consent
Have the legal capacity to enter into binding contracts
Not have been previously suspended or removed from the Platform
Meet specific eligibility criteria applicable to your User Category (e.g., certified coaches, licensed venues, registered game officials)
Not be located in, or a resident of, a jurisdiction where access to or use of the Platform is prohibited by law
Play Providers who offer commercial Services through the Platform (including coaching, venue management, equipment rental, or any other paid Listing) must be at least 18 years of age or the age of majority in their jurisdiction, whichever is greater. Minors may not operate as Play Providers, even with parental or guardian consent, unless expressly permitted by applicable law and approved by FindPlay in writing.
FindPlay reserves the right to request additional documentation to verify your eligibility at any time. Failure to provide such documentation may result in restriction, suspension, or termination of your account.
FindPlay may modify these Terms at any time. When we make material changes, we will provide you with at least 30 days' notice via email, in-app notification, or a prominent notice on the Platform before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Platform and close your account. Changes will not apply retroactively to bookings confirmed before the effective date unless required by law.
Your use of the Platform may also be governed by the following additional terms, which are incorporated by reference:

Data Processing Agreement (for enterprise and organizational accounts processing personal data)
In the event of a conflict between these Terms and any additional terms, these Terms prevail unless the additional terms expressly state otherwise.
In these Terms, the following definitions apply unless the context requires otherwise:
"Account" means a registered user profile on the Platform, which may include Individual, Team/Group, Organization, or Community account types, each with varying levels of access and functionality.
"Affiliate" means any individual or entity participating in FindPlay's affiliate or referral program, including influencers, third-party promoters, pro-players, and talent management agencies.
"Affiliate Program" means FindPlay's affiliate and referral program as described in Section 6.7, through which approved Affiliates promote Services and Listings in exchange for commissions.
"AI Features" means any artificial intelligence, machine learning, or automated decision-making systems used by the Platform, including personalized recommendations, smart matching, search ranking, curated playlists, conversational AI assistance, content moderation, and fraud detection.
"Booking" means the reservation or purchase of any Service through the Platform, resulting in a binding agreement between the Player and the Play Provider.
"Cancellation Policy" means the specific rules governing cancellation of a Booking, including provisions for refunds, rescheduling, and fees, as set by Play Providers or FindPlay.
"Code of Conduct" means the FindPlay Code of Conduct and Safety-First Guidelines document as described in Section 8.7, which establishes behavioural standards, fair play expectations, and safety-first principles for all Users.
"Commission" means the percentage of the Booking fee retained by FindPlay as compensation for Platform services.
"Content" means any text, graphics, images, music, software, audio, video, data, information, or other materials available on or through the Platform.
"Dispute" means any disagreement, claim, or controversy arising out of or relating to these Terms, the Platform, or any interaction between Users.
"Force Majeure Event" means an event beyond a party's reasonable control, including but not limited to acts of God, pandemic, epidemic, quarantine, war, terrorism, riots, natural disasters, government actions, cyberattacks, widespread technological failures, and public health emergencies.
"Health Data" means any data relating to a User's physical health, fitness, biometrics, or wellness, including data obtained through integration with third-party health platforms and wearable devices.
FindPlay serves diverse participants in the sports, fitness, and recreation ecosystem. The following categories describe the primary roles Users may hold on the Platform:
"Active People & Players" – Individuals seeking to discover and participate in sports, fitness, or recreational activities.
"Teams & Groups" – Organized teams, clubs, and informal groups managing memberships, scheduling, and group participation.
"Staff & Volunteers" – Individuals supporting events and activities through operational, administrative, or volunteer roles.
"Game Officials" – Referees, umpires, judges, and other officials ensuring fair play and competition integrity.
"Coaches, Instructors & Experts" – Qualified professionals offering training, coaching, education, and skill development services.
"Schools & Universities" – Educational institutions managing sports programs, facilities, and student engagement.
"Sport & Fitness Clubs" – Gyms, clubs, academies, and associations operating sport and fitness programs.
"Venue Managers" – Operators of sports facilities, fields, courts, pools, and recreational spaces.
"Fundraising & Sponsorships" – Individuals and organizations connecting financial supporters with teams, events, and sports programs.
"Influencers" – Content creators, athletes, and public figures promoting sports, fitness, and recreational activities.
"Employers" – Businesses and organizations offering sports-based wellness and team-building initiatives.
"Brands & Partnerships" – Companies and suppliers of sports equipment, apparel, and related services.
"Federations & Franchises" – Governing bodies, peak bodies, and franchise networks overseeing structured competition and industry standards.
"Governments" – Public institutions managing sports policies, community health programs, and public facilities.
"Community" – Informal collectives of individuals joining together for a shared interest in play, without formal organizational registration.
Users may operate in multiple categories simultaneously. FindPlay does not guarantee the qualifications, competence, or suitability of any User in any category.
The Platform supports the following listing types:
Experiences (activities, classes, events, competitions, social meetups)
Facility & Equipment (venue bookings, equipment rentals, facility hire)
Coaching (private coaching, group coaching, clinics, development programs)
Employment (job listings, volunteer positions, officiating opportunities)
Fundraising (donation campaigns, sponsorship requests, custom merchandise)
Rewards (discount offers, loyalty programs, brand promotions)
Courses & Programs (structured learning, certifications, development pathways)
"Payment" means any transfer of funds through the Platform.
"Payout" means the disbursement of funds to Play Providers for completed Services.
"Refund" means the return of payments to Players.
"Tax" includes all applicable taxes, levies, duties, sales tax, GST, VAT, and other government charges.
FindPlay's mission is to connect people with active lifestyles through seamless discovery, booking, and engagement in sports, fitness, and recreation. We empower users to find, create, promote, and connect within the world of play, making active participation more accessible, affordable, and rewarding for everyone.
FindPlay operates as a technology platform and online marketplace that connects Players with Play Providers. FindPlay is not a sports provider, venue operator, coach, employer, or event organizer. FindPlay does not own, control, offer, manage, or deliver any of the Listings or Services advertised on the Platform. When Players book Services through the Platform, the contract for the provision of those Services is formed directly between the Player and the Play Provider. FindPlay is not a party to that contract.
FindPlay does not:
Guarantee the quality, safety, legality, suitability, or availability of any Listing or Service
Employ, endorse, or recommend any Play Provider, Player, or other User
Act as an agent for any Play Provider or Player (except to the limited extent described in the payment processing sections)
Bear responsibility for the conduct, whether online or offline, of any User
Provide medical, fitness, nutritional, or health advice
The Platform enables Users to:
Discover and Access: Search, filter, browse, and book sports, fitness, and recreational opportunities using AI-powered discovery tools, interactive maps, curated playlists, and personalized recommendations.
Create and Manage: Create and manage Listings, events, classes, coaching sessions, courses, fundraisers, and more using templates, scheduling tools, and administration features.
Promote and Grow: Promote offerings through integrated marketing tools, affiliate programs, sponsored listings, and multi-channel distribution networks.
Connect and Collaborate: Build profiles, communicate with other Users, manage teams, share achievements, and participate in communities.
Transact Securely: Process payments, manage subscriptions, issue refunds, and track financial performance through integrated payment processing.
Track and Improve: Access analytics, track participation, monitor progress, and integrate with health and fitness wearables.
Build Custom Marketplaces: Create branded Micro-Marketplaces for federations, franchises, employers, and other organizations.
FindPlay is committed to making play accessible to the greatest number of people. We actively support adaptive and inclusive play to facilitate participation for people of all abilities. We strive to conform to Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards and continuously work to improve accessibility. We welcome feedback at support@findplay.com.
FindPlay promotes Positive Play – an ethos that goes beyond outcomes and focuses on creating empowering, respectful, and inclusive environments for all participants. All Users are expected to conduct themselves in accordance with our Positive Play principles, Community Standards, and Code of Conduct (see Section 8.7).
FindPlay uses artificial intelligence, machine learning, and automated systems to enhance the Platform experience, including personalized activity recommendations, search result ranking, AI-generated playlists, smart matching, and conversational AI assistance ("AI Features").
You acknowledge and agree that:
(a) AI Features are provided for informational and convenience purposes only and do not constitute professional advice of any kind, including medical, fitness, safety, or suitability advice;
(b) AI-generated recommendations, suggestions, and content may be inaccurate, incomplete, or unsuitable for your individual circumstances, and you should independently verify any information before relying on it;
(c) FindPlay does not guarantee the accuracy, completeness, reliability, or appropriateness of any output generated by AI Features;
(d) AI Features may use your personal data, preferences, activity history, and Health Data (where you have provided consent) to generate personalized recommendations in accordance with our Privacy Policy;
(e) Automated systems may be used for content moderation, fraud detection, search ranking, and trust and safety decisions. Where automated decisions materially affect your account or access, you may request human review by contacting support@findplay.com;
(f) FindPlay disclaims all liability for any loss, injury, or damage arising from your reliance on AI-generated recommendations or automated decisions, to the maximum extent permitted by applicable law;
(g) FindPlay may modify, suspend, or discontinue AI Features at any time without notice.
FindPlay is committed to transparency regarding its use of AI. Where AI is used to generate content visible to Users (such as listing descriptions, summaries, or recommendations), FindPlay will endeavor to indicate that the content has been AI-generated or AI-assisted. Where applicable state or federal law requires disclosure of AI use in consumer-facing applications, FindPlay will comply with such requirements.
A Micro-Marketplace is a custom-branded marketplace created by a Play Provider ("Marketplace Operator") using FindPlay's marketplace building tools. Micro-Marketplaces may be identified by the "Powered by FindPlay" designation, FindPlay branding, or similar indicators.
These Terms apply in full to all Users of any Micro-Marketplace that is powered by, hosted on, or facilitated through FindPlay's technology infrastructure, regardless of the branding, domain name, or visual appearance of the Micro-Marketplace. By accessing or using any Micro-Marketplace that displays the "Powered by FindPlay" mark or uses FindPlay's technology infrastructure, you agree to be bound by these Terms in addition to any terms established by the Marketplace Operator.
Where a Marketplace Operator establishes additional terms for their Micro-Marketplace:
(a) The Marketplace Operator's terms must not conflict with or diminish FindPlay's Terms, Privacy Policy, or Community Standards;
(b) In the event of any conflict between the Marketplace Operator's terms and these Terms, these Terms shall prevail to the extent of the inconsistency;
(c) The Marketplace Operator's terms may impose additional obligations on Users of their Micro-Marketplace (such as sport-specific rules, membership requirements, or code of conduct provisions), provided they comply with all applicable laws;
(d) The Marketplace Operator is solely responsible for the content, accuracy, and legality of any additional terms they impose.
Marketplace Operators must:
(a) Clearly display FindPlay's Terms and Privacy Policy (or provide accessible links thereto) within their Micro-Marketplace;
(b) Not misrepresent the nature of their relationship with FindPlay;
(c) Not modify, obscure, or remove the "Powered by FindPlay" designation without FindPlay's written consent;
(d) Ensure all Listings, Services, and User interactions within their Micro-Marketplace comply with these Terms and all applicable laws;
(e) Maintain appropriate data processing agreements where they access personal data of Users through the Micro-Marketplace;
(f) Not use FindPlay's technology to facilitate activities that would violate these Terms if conducted on the main FindPlay Platform;
(g) Comply with all applicable Micro-Marketplace service agreements entered into with FindPlay.
FindPlay provides the technology infrastructure for Micro-Marketplaces but does not control the Marketplace Operator's business decisions, branding choices, or management of their community. FindPlay is not a party to any agreements between Marketplace Operators and Users of their Micro-Marketplaces, except to the extent set out in these Terms. FindPlay reserves the right to suspend or terminate any Micro-Marketplace that violates these Terms or poses a risk to Users or the Platform's reputation.
FindPlay is not responsible for the conduct, policies, or decisions of Marketplace Operators. The disclaimers and limitations of liability in Section 12 apply equally to Micro-Marketplaces. Users of Micro-Marketplaces acknowledge that FindPlay's role is limited to providing the technology platform and payment processing infrastructure.
To access certain features of the Platform, you must register for an account. During registration, you agree to:
Provide accurate, complete, and current information
Maintain and promptly update your information to keep it accurate and current
Not create more than one account per individual (unless authorized by FindPlay)
Not assign or transfer your account to another party
Choose a strong password and maintain its confidentiality
Any false, misleading, or materially incomplete information may result in suspension or termination of your account.
The Platform offers different account types with varying levels of access and functionality, including Individual, Team/Group, Organization, and Community accounts. Each account may hold one or more roles (e.g., Coach, Venue Manager, Game Official, Facility Provider). Your access to certain features depends on your account type and role(s).
FindPlay may require identity verification for certain Users or activities. This may include:
Government-issued photo identification
Professional certifications, licenses, or accreditations (e.g., coaching qualifications)
Proof of insurance (e.g., public liability insurance for coaches or venues)
Background checks, including child safety clearances where required by law (e.g., Working With Children Checks in Australia, state-specific background checks in the United States)
Business registration, EIN, or ABN verification
Payment method verification
FindPlay does not guarantee the identity of any User. Verification is a risk-reduction measure, not a guarantee. Users remain responsible for conducting their own due diligence before engaging with other Users.
You are solely responsible for all activity that occurs under your account, whether or not authorized by you. You must:
Maintain the confidentiality of your login credentials
Notify FindPlay immediately at support@findplay.com if you become aware of any unauthorized access or security breach
Not share your account credentials with any third party
FindPlay will not be liable for any loss or damage arising from unauthorized use of your account. FindPlay may implement additional security measures such as two-factor authentication, session management, and suspicious activity monitoring.
You may terminate your account at any time by contacting support@findplay.com or through the account settings page. Upon termination:
Access to all Platform features will cease
Outstanding Bookings will be handled in accordance with applicable cancellation policies
Any outstanding Payouts owed to you will be processed in accordance with the standard Payout schedule
User Content may be retained as described in our Privacy Policy
You remain liable for any outstanding obligations incurred prior to termination
You may request a copy of your personal data in a commonly used, machine-readable format within 30 days of termination by contacting support@findplay.com. FindPlay will endeavor to provide the requested data within 30 days, subject to applicable data protection laws and any legal obligations requiring continued retention.
FindPlay may restrict, suspend, or terminate your account if:
You breach these Terms, Community Standards, Code of Conduct, or any applicable additional terms
You engage in conduct that is harmful, fraudulent, discriminatory, or otherwise objectionable
You fail to provide requested verification documentation
We receive credible complaints from other Users about your conduct
We are required to do so by law or regulation
Your account has been inactive for more than 24 consecutive months
Where practicable, FindPlay will provide notice and an opportunity to resolve the issue before suspension or termination, unless immediate action is necessary to protect the safety of Users or the integrity of the Platform. You may appeal any action by contacting support@findplay.com.
Upon termination, provisions that by their nature should survive will continue in force, including but not limited to Sections relating to intellectual property, limitation of liability, indemnification, dispute resolution, and any outstanding payment obligations.
All communications sent through the Platform (including messages, booking requests, reviews, and support interactions) may be monitored, recorded, and stored by FindPlay for the purposes of:
(a) Facilitating the delivery of Services and resolving disputes;
(b) Ensuring compliance with these Terms and Community Standards;
(c) Protecting the safety of Users;
(d) Improving the Platform and User experience;
(e) Complying with legal obligations.
By using the Platform's communication features, you consent to the monitoring and recording of your communications. You agree not to use the Platform's communication tools to exchange personal contact information for the purpose of circumventing Platform fees or completing transactions outside the Platform.
FindPlay is committed to the safety of children and young people. All Users must comply with applicable child protection laws, including the Children's Online Privacy Protection Act (COPPA) in the United States and equivalent legislation in other jurisdictions.
(a) Play Providers providing Services to minors (persons under 18 years of age) must hold all required background checks, clearances, or certifications as required by their jurisdiction (e.g., Working With Children Checks in Australia, state-specific background checks in the United States) and maintain them throughout their use of the Platform;
(b) Parents or guardians are responsible for supervising their children's use of the Platform and for assessing the suitability and safety of any Service for their child;
(c) Play Providers must not communicate privately with minors through the Platform except through channels that are also visible to the minor's parent or guardian;
(d) Any User who becomes aware of potential child safety concerns must immediately report them to FindPlay at safety@findplay.com and, where appropriate, to relevant authorities;
(e) FindPlay reserves the right to immediately suspend any User who is the subject of credible child safety concerns, pending investigation;
(f) FindPlay does not knowingly collect personal information from children under the age of 13 without verifiable parental consent, in compliance with COPPA. If we learn that we have collected personal information from a child under 13 without parental consent, we will take steps to delete such information promptly.
Play Providers are responsible for ensuring that their Listings are accurate, complete, lawful, and not misleading. Listings must include:
A clear and accurate description of the Service offered
All material terms including pricing, duration, location, and any prerequisites
Any applicable restrictions (e.g., age, skill level, equipment requirements, health considerations)
Accurate cancellation policies
Compliance with all applicable laws, regulations, and industry standards
FindPlay reserves the right to remove, modify, or restrict the visibility of any Listing that violates these Terms, is inaccurate, or poses a risk to Users.
When a Player books a Service through the Platform:
A binding agreement is formed directly between the Player and the Play Provider upon booking confirmation
The Player agrees to pay the Total Price, which includes the Listing price, applicable Service Fees, taxes, and any other charges disclosed at checkout
The Play Provider agrees to provide the Service as described in the Listing
Both parties agree to the applicable Cancellation Policy
FindPlay facilitates this process but is not a party to the agreement between Players and Play Providers.
Play Providers must:
Hold all necessary licenses, permits, registrations, and insurance required by applicable law
Comply with all applicable health and safety regulations
Provide Services as described in their Listings
Maintain appropriate qualifications and credentials for the Services they offer
Respond promptly to Bookings, inquiries, and issues
Comply with FindPlay's Community Standards, Code of Conduct, and Positive Play principles
Ensure any venues, equipment, or materials used are safe and fit for purpose
Players must:
Read and understand all Listing details, including prerequisites and cancellation policies, before booking
Assess their own fitness, health, and skill level for any activity
Consult a qualified medical professional before participating in any physical activity, particularly if they have pre-existing health conditions
Comply with all Play Provider rules, venue policies, and safety instructions
Arrive on time and bring any required equipment or documentation
Treat Play Providers, other participants, and property with respect
Certain activities and venues may have additional requirements including skill level verification, certification checks, equipment standards, safety training, minimum age requirements, or health declarations. Users are responsible for reviewing and meeting all applicable requirements.
FindPlay may create preliminary profiles for sports and fitness providers using publicly available information ("Unclaimed Profiles") to enhance Platform discovery and user experience. You acknowledge that:
(a) Unclaimed Profiles are created using publicly available information and may not be fully accurate, complete, or current;
(b) FindPlay does not endorse or verify the accuracy of information in Unclaimed Profiles;
(c) If you identify a profile relating to your business or organization, you may claim it by verifying your identity and association with the listed entity. Upon claiming, you become responsible for maintaining the accuracy of the profile information;
(d) If you believe an Unclaimed Profile contains inaccurate information about your business, you may request correction or removal by contacting support@findplay.com. FindPlay will use reasonable efforts to action such requests within 14 business days;
(e) FindPlay reserves the right to create, modify, or remove Unclaimed Profiles at its discretion;
(f) Unclaimed Profiles do not constitute a Listing and no Bookings can be made through an Unclaimed Profile until the provider claims their profile and creates a Listing.
Users who create Fundraising Listings acknowledge and agree that:
(a) They are solely responsible for ensuring compliance with all applicable charitable fundraising laws and regulations in their jurisdiction, including any registration, licensing, or reporting requirements (such as state-level charitable solicitation registration in the United States);
(b) All funds raised through Fundraising Listings must be used for the stated purpose described in the Listing. Misuse of donated funds is a serious breach of these Terms;
(c) FindPlay does not verify the legitimacy of Fundraising Listings or the use of funds raised. FindPlay is not a fiduciary, trustee, or custodian of donated funds;
(d) FindPlay charges a platform fee on Fundraising Listings as disclosed at the time of listing creation. This fee is separate from any payment processing fees charged by Stripe;
(e) Donors acknowledge that contributions made through Fundraising Listings are made directly to the fundraising User and not to FindPlay. FindPlay does not guarantee the tax-deductibility of any contribution;
(f) FindPlay reserves the right to suspend or remove any Fundraising Listing that appears fraudulent, misleading, or in violation of these Terms or applicable law.
Play Providers offering equipment for rental through the Platform are solely responsible for:
(a) Ensuring all equipment is safe, well-maintained, fit for purpose, and compliant with applicable safety standards;
(b) Providing accurate descriptions of equipment condition, specifications, and any known defects;
(c) Maintaining appropriate insurance covering equipment rental activities;
(d) Providing any necessary safety instructions, training, or protective equipment to renters;
(e) Inspecting equipment before and after each rental period.
Players renting equipment acknowledge that they accept the inherent risks of using sporting and recreational equipment and are responsible for using equipment safely, in accordance with the Play Provider's instructions, and returning equipment in the condition received (reasonable wear and tear excepted).
FindPlay is not responsible for the condition, safety, or suitability of any equipment rented through the Platform.
Where a Service or Listing has reached its maximum capacity, Players may join a waitlist if this feature is enabled by the Play Provider. By joining a waitlist, you acknowledge and agree that:
(a) Placement on a waitlist does not guarantee a booking. Waitlist positions are offered on a first-come, first-served basis unless the Play Provider specifies an alternative priority method in their Listing;
(b) If a spot becomes available, you will be notified via the Platform (and optionally by email or push notification) and given a reasonable time window to confirm your booking, as specified by the Play Provider (typically 24 hours unless otherwise stated). Failure to confirm within this window forfeits your waitlist position;
(c) Upon confirmation from the waitlist, the booking is subject to the same terms, pricing, and Cancellation Policy as a standard booking for the relevant Listing;
(d) You may remove yourself from a waitlist at any time without penalty;
(e) FindPlay is not responsible for any loss or disappointment arising from failure to secure a spot from a waitlist;
(f) Play Providers are responsible for managing their waitlists fairly and in accordance with any published waitlist policies.
Certain Services may require Players to acknowledge, accept, or sign digital waivers, assumption of risk agreements, medical declarations, or other participant agreements prior to participation. You acknowledge and agree that:
(a) Play Providers may require the completion of digital waivers or participant agreements as a condition of participation in their Services. These may include acknowledgment of inherent risks, medical disclosures, facility rules, and liability releases;
(b) Digital waivers presented through the Platform are agreements between the Player and the Play Provider. FindPlay facilitates the presentation and collection of these waivers but is not a party to them and makes no representation regarding their enforceability;
(c) It is the Play Provider's sole responsibility to ensure that any waivers or participant agreements they require comply with applicable laws in their jurisdiction, including requirements for informed consent, clear and conspicuous disclosure, and any limitations on liability waivers (such as those under Australian Consumer Law or state consumer protection statutes in the United States);
(d) Players are responsible for reading and understanding any waiver or participant agreement before accepting it. Acceptance of a digital waiver through the Platform (including by clicking "I Agree," "Accept," or similar mechanisms) constitutes your electronic signature and agreement to the terms contained therein;
(e) Parents or guardians must review and accept waivers on behalf of minors. Play Providers offering Services to minors must ensure their waivers include appropriate provisions for parental or guardian consent;
(f) FindPlay may retain copies of executed digital waivers for record-keeping and dispute resolution purposes, as described in our Privacy Policy;
(g) FindPlay disclaims all liability arising from the content, enforceability, or adequacy of any waiver or participant agreement created by a Play Provider.
FindPlay charges fees for various Platform services, which may include:
Service Fees: A fee added to or deducted from transactions to support Platform operations. The default is to add the Service Fee to the Play Provider's price so Play Providers are not adversely affected.
Subscription Fees: Recurring fees for premium features, enhanced listings, or advanced tools based on the User's selected plan.
Transaction Fees (Commission): A percentage of completed Booking revenue retained by FindPlay.
Promoted Listing Fees: Fees for enhanced visibility and promotion of Listings.
Micro-Marketplace Fees: Fees for creating and operating custom-branded marketplaces.
Data and Analytics Fees: Fees for access to advanced analytics, insights, and data products.
All applicable fees, including any taxes, are disclosed to Users before completing any transaction or subscription. The most current pricing information is available on the FindPlay Pricing Page at [Insert Pricing URL].
FindPlay is committed to price transparency. The total cost of any Booking, including all applicable Service Fees, taxes, and charges, will be clearly disclosed to the Player before they confirm the Booking. No additional fees will be charged after Booking confirmation unless expressly agreed. Play Providers must include all mandatory costs in their Listing price and must not impose undisclosed surcharges or fees on Players. FindPlay does not engage in "drip pricing" — the price you see at checkout is the price you pay.
FindPlay Service Fees do not apply to:
Job Listings
Fundraising Listings (which are subject to separate platform fees)
Micro-Marketplace operational fees (governed by separate agreements)
All payments must be made through the Platform using supported payment methods. Payment processing is provided by Stripe and is subject to the Stripe Connected Account Agreement and Stripe Terms of Service. By using the Platform's payment features, you agree to be bound by those terms.
Stripe charges transaction fees that vary by country and transaction type. These fees are set by Stripe and may change. Current Stripe pricing is available at stripe.com/pricing. FindPlay is not responsible for Stripe's fees or fee changes.
FindPlay disburses Payouts to Play Providers for completed Services, less applicable FindPlay fees and taxes. Key Payout terms:
Standard Payout schedule is net 7 days after Service completion
Expedited Payout options may be available subject to additional fees and eligibility
Payouts are made to the bank account or payment method registered in your Stripe Connected Account
FindPlay may hold, delay, or offset Payouts where there are pending disputes, claims, chargebacks, or suspected fraudulent activity
FindPlay reserves the right to modify Payout schedules and methods with reasonable notice to Play Providers.
Users are solely responsible for determining and paying all applicable taxes (including sales tax, use tax, GST, VAT, income tax, and any other local, state, federal, or international taxes) arising from their use of the Platform and participation in transactions. FindPlay may collect and remit taxes where required by law, including sales tax in applicable U.S. states and jurisdictions. FindPlay does not provide tax advice, and Users should consult a qualified tax professional.
FindPlay Service Fees and Subscription Fees are subject to applicable sales tax, GST, VAT, or other consumption taxes as required by law.
All applicable taxes must be carefully calculated and added to the prices displayed on Listings where required by law. FindPlay will ensure that taxes are clearly itemized and transparently presented to Users. Specifically:
(a) All receipts, invoices, and transaction confirmations generated through the Platform will clearly itemize each applicable tax by its official title (e.g., "GST," "State Sales Tax," "VAT") and the amount applied, as a separate line item distinct from the Listing price, Service Fees, and any other charges;
(b) Play Providers are responsible for configuring the correct tax rates applicable to their Services and jurisdiction. Where FindPlay provides automated tax calculation tools, these are offered as a convenience and do not constitute tax advice. Play Providers must verify that the tax rates applied to their Listings are accurate and comply with applicable law;
(c) Where multiple taxes apply to a single transaction (e.g., combined state and local sales taxes, or GST plus a state surcharge), each tax will be displayed as a separate line item;
(d) Players will have access to a complete transaction history, including itemized tax documentation, through their account dashboard. Play Providers will have access to tax summaries and reports for their transactions to assist with their own tax reporting obligations;
(e) FindPlay may issue tax-related documentation (such as 1099 forms in the United States or BAS summaries in Australia) to Play Providers where required by applicable tax law;
(f) In the event of a refund, any taxes collected in connection with the refunded transaction will be refunded to the Player in the same proportion as the original charge, unless otherwise required by law.
FindPlay may modify its fee structure at any time. Users will receive at least 30 days' notice of material fee changes prior to the effective date, except where changes are mandated by law or are beneficial to Users (e.g., fee reductions). Fee changes will not affect Bookings confirmed prior to the effective date. If you disagree with a fee change, you may terminate your account.
FindPlay operates an affiliate and referral program ("Affiliate Program") that enables approved participants ("Affiliates") to promote Services and Listings on the Platform in exchange for commissions. The Affiliate Program is governed by these Terms, the Affiliate Program Agreement (available at [Insert Affiliate Agreement URL]), and any additional terms communicated to Affiliates upon enrolment.
(a) Participation in the Affiliate Program requires application and approval by FindPlay. FindPlay reserves the right to accept or reject any application at its sole discretion and without obligation to provide reasons;
(b) Affiliates may include individuals, content creators, athletes, influencers, talent management agencies, sports organisations, media publishers, and other entities approved by FindPlay;
(c) Affiliates must provide accurate information during the enrolment process and maintain their information throughout their participation. Affiliates must comply with all applicable laws, including advertising disclosure requirements (such as FTC Endorsement Guidelines in the United States and the Australian Association of National Advertisers Code of Ethics);
(d) FindPlay may require Affiliates to complete onboarding, training, or certification before they begin promoting Listings;
(e) Affiliate accounts are non-transferable. Affiliates may not assign or sublicense their affiliate relationship without FindPlay's prior written consent.
(a) Default participation: Play Providers' Listings are eligible for promotion through the Affiliate Program by default. Play Providers are notified of this upon account creation and may manage their participation preferences at any time through their account settings;
(b) Opt-out rights: Play Providers may opt out of the Affiliate Program entirely, or exclude specific Listings from affiliate promotion, at any time through their account settings. Opt-out takes effect within 48 hours and applies to all future affiliate referrals. Commissions on Bookings that were referred before the opt-out took effect remain payable;
(c) Opt-in for enhanced participation: Play Providers may opt in to enhanced affiliate features, such as offering increased commission rates to attract more affiliate promotion, creating custom affiliate campaigns, or providing Affiliates with exclusive promotional content. Enhanced participation is subject to additional terms disclosed at the time of opt-in;
(d) No obligation to accept affiliate-driven Bookings: Opting in to the Affiliate Program does not create any obligation for Play Providers to accept individual Bookings. Play Providers retain full control over their Listing availability, pricing, and Booking acceptance;
(e) FindPlay will provide Play Providers with visibility into affiliate activity on their Listings, including referral sources, conversion data, and commission amounts, through the Play Provider dashboard.
(a) Affiliate commissions are derived from FindPlay's Service Fees and are not charged as an additional cost to Play Providers, unless the Play Provider has opted into an enhanced commission arrangement under Section 6.7.2(c);
(b) Default model — FindPlay absorbs: Under the default Affiliate Program structure, the affiliate commission is funded entirely from FindPlay's portion of the Service Fee. The Play Provider receives the same Payout amount regardless of whether the Booking was referred by an Affiliate. The Player pays the same Total Price regardless of affiliate involvement;
(c) Enhanced model — Provider-funded uplift: Where a Play Provider opts to offer enhanced commission rates to attract greater affiliate promotion, the additional commission above the default rate is funded by the Play Provider and deducted from their Payout. The specific uplift amount and its impact on Payouts will be clearly disclosed to the Play Provider before they confirm the enhanced arrangement;
(d) Player-facing pricing: Affiliate referrals must not result in higher prices for Players compared to non-referred Bookings for the same Listing. Affiliates may share discount codes or promotional offers with Players where authorised by FindPlay or the Play Provider, but may not inflate prices or add surcharges;
(e) Commission rates, structures, and tiers are set by FindPlay and communicated to Affiliates in the Affiliate Program Agreement. FindPlay may modify commission rates with at least 30 days' notice to Affiliates. Changes to commission rates do not affect commissions on Bookings confirmed before the effective date of the change.
(a) Affiliate commissions are calculated on completed Bookings where the Service has been delivered and the Play Provider's Payout has been processed. No commission is payable on cancelled, refunded, or disputed Bookings (except where only a partial refund is issued, in which case a proportionate commission may be payable);
(b) Commissions accrue in the Affiliate's account and are disbursed on a monthly cycle, provided the accrued balance meets the minimum payout threshold of USD $25 (or local currency equivalent). Balances below the threshold carry forward to the next payment cycle;
(c) Payouts to Affiliates are processed through the Platform's payment infrastructure (currently Stripe) to the payment method registered in the Affiliate's account. Affiliates are responsible for maintaining accurate and current payment information;
(d) FindPlay will provide Affiliates with detailed commission statements, including Booking reference, commission amount, and status (pending, confirmed, or clawed back), accessible through the Affiliate dashboard;
(e) FindPlay reserves the right to withhold or delay commission payments where there are pending disputes, suspected fraud, policy violations, or ongoing investigations involving the Affiliate's account.
(a) If a Booking for which a commission was paid is subsequently cancelled, refunded (in whole or in part), or subject to a chargeback, FindPlay may claw back the corresponding commission amount from the Affiliate's accrued balance or offset it against future commissions;
(b) Where a partial refund is issued, the commission will be adjusted proportionately;
(c) If a Booking is disputed and subsequently resolved in favour of the Player (resulting in a refund), the associated commission will be reversed;
(d) FindPlay will notify Affiliates of any clawback or adjustment through the Affiliate dashboard and, where the adjustment exceeds USD $50, by email;
(e) Commissions attributable to fraudulent, self-referred, or policy-violating Bookings are void and subject to immediate clawback, regardless of whether the commission has already been paid out.
Affiliates must comply with the following conduct standards in addition to the general User conduct requirements in Section 8:
(a) All promotional content must be honest, accurate, and not misleading. Affiliates must not make claims about a Service, Play Provider, or the Platform that are false, exaggerated, or unsubstantiated;
(b) Affiliates must clearly disclose their affiliate relationship with FindPlay in all promotional content, in compliance with applicable advertising disclosure laws and regulations (including FTC Endorsement Guidelines, ACCC advertising standards, and equivalent requirements in other jurisdictions). Disclosure must be clear, conspicuous, and proximate to any promotional claim or link;
(c) Affiliates must not engage in spam, unsolicited communications, or any form of promotion that violates applicable anti-spam laws (such as the CAN-SPAM Act in the United States or the Spam Act 2003 in Australia);
(d) Affiliates must not use deceptive techniques to generate referrals, including cookie stuffing, click fraud, misleading redirects, typosquatting, or impersonation of FindPlay or any Play Provider;
(e) Affiliates must not post fake reviews, ratings, or testimonials, or incentivise others to do so in connection with affiliate promotions;
(f) Affiliates must not bid on FindPlay's brand name, trademarks, or variations thereof in paid search advertising without FindPlay's prior written consent;
(g) Affiliates must not promote Listings or Services that they know or reasonably suspect to be fraudulent, unsafe, or in violation of these Terms;
(h) Affiliates must respect Play Provider opt-out decisions and must not continue to promote Listings that have been excluded from the Affiliate Program.
FindPlay is committed to protecting Play Providers from adverse impacts of the Affiliate Program:
(a) Play Providers will not experience reduced Payouts as a result of affiliate-referred Bookings under the default commission model;
(b) Play Providers have complete visibility into affiliate activity on their Listings and can monitor referral performance, commission costs (where applicable), and Affiliate identity through their dashboard;
(c) Play Providers may report concerns about specific Affiliate conduct (such as misleading promotion, brand misrepresentation, or inappropriate content) to support@findplay.com. FindPlay will investigate and take appropriate action;
(d) Where an Affiliate's promotional activity materially misrepresents a Play Provider's Service, brand, or reputation, FindPlay will take prompt action to remove the offending content and may suspend or terminate the Affiliate's participation;
(e) Play Providers retain full control over their Listing content, pricing, and Booking policies. Affiliates may not modify or override these on behalf of Play Providers.
(a) Disputes between Affiliates and Play Providers should be raised through FindPlay's support channels at support@findplay.com. FindPlay will review the dispute and may mediate a resolution, but is not obligated to do so;
(b) Common dispute categories include: attribution disagreements (whether a Booking was genuinely referred by the Affiliate), misrepresentation claims (Affiliate promoting a Service inaccurately), and commission disputes (disagreement over commission amounts or clawbacks);
(c) FindPlay's tracking and attribution systems are the definitive record for determining whether a Booking was referred by an Affiliate. In the event of a dispute over attribution, FindPlay's system data will be treated as authoritative;
(d) Where a dispute cannot be resolved through FindPlay's mediation, either party may pursue resolution in accordance with the dispute resolution procedures in Section 14 of these Terms;
(e) FindPlay reserves the right to suspend commission payments related to Bookings that are the subject of an active dispute until the dispute is resolved.
(a) Affiliates may terminate their participation in the Affiliate Program at any time by providing written notice to FindPlay or through their account settings. Upon termination, accrued commissions meeting the minimum payout threshold will be disbursed in the next regular payment cycle. Commissions below the threshold are forfeited unless applicable law requires otherwise;
(b) FindPlay may suspend or terminate an Affiliate's participation immediately if the Affiliate breaches these Terms, the Affiliate Program Agreement, or the conduct standards in Section 6.7.6, or if FindPlay reasonably suspects fraudulent activity;
(c) FindPlay may terminate the Affiliate Program or any Affiliate's participation for convenience with 30 days' written notice. Commissions on Bookings confirmed before the termination effective date remain payable;
(d) Upon termination, Affiliates must promptly remove all FindPlay promotional materials, tracking links, and branding from their channels;
(e) Provisions relating to commission clawback, confidentiality, intellectual property, and dispute resolution survive termination of Affiliate participation.
FindPlay and its partners may offer rewards, discounts, and promotional offers to Players. These are subject to specific terms and conditions disclosed at the time of the offer.
Transactions are processed in the local currency of the Play Provider's country unless otherwise specified. Currency conversion, where applicable, is handled by our Payment Provider and subject to their exchange rates and fees.
(a) Promotional credits issued by FindPlay are non-transferable, non-refundable, and have no cash value unless required by law. Credits may have expiration dates which will be communicated at the time of issue, subject to applicable laws governing promotional credits and gift cards in your jurisdiction;
(b) Gift cards purchased through the Platform are subject to the terms and conditions published at the time of purchase and all applicable consumer protection laws;
(c) FindPlay reserves the right to modify, suspend, or terminate any promotional program at any time with reasonable notice;
(d) Promotional offers cannot be combined unless expressly stated. FindPlay may limit the number of promotional offers available per User;
(e) Abuse of promotional programs (including creating multiple accounts to claim offers, or exploiting system errors) is a breach of these Terms and may result in account suspension and forfeiture of credits.
If you purchase a Subscription to access premium features or enhanced Platform capabilities, the following terms apply:
(a) Subscriptions automatically renew at the end of each billing period (monthly or annually, as selected) unless you cancel before the renewal date. You will be charged the then-current Subscription fee for each renewal period;
(b) FindPlay will provide clear disclosure of auto-renewal terms, including the renewal price and billing frequency, at the time of purchase and in your subscription confirmation, in compliance with applicable auto-renewal laws (including the FTC's Negative Option Rule in the United States, applicable state auto-renewal statutes such as California's Automatic Renewal Law (Cal. Bus. & Prof. Code § 17600 et seq.), and the Australian Consumer Law);
(c) You may cancel your Subscription at any time through your account settings or by contacting support@findplay.com. Cancellation will take effect at the end of the current billing period, and you will retain access to premium features until that date;
(d) FindPlay will send a reminder notification at least 7 days before each renewal date, clearly stating the renewal amount and providing a simple mechanism to cancel;
(e) If FindPlay increases the Subscription fee, you will be notified at least 30 days before the new fee takes effect and given the opportunity to cancel before being charged at the new rate;
(f) Refunds for partial billing periods are generally not provided unless required by applicable consumer protection law or at FindPlay's discretion. Where applicable law entitles you to a pro-rata refund upon cancellation, FindPlay will comply with such requirements;
(g) Free trial periods, if offered, will convert to paid Subscriptions at the end of the trial unless cancelled. The conversion terms, including the post-trial price, will be clearly disclosed before the trial begins.
FindPlay facilitates Bookings between Players and Play Providers. Cancellation and refund rights are primarily governed by the Play Provider's published Cancellation Policy, which Players must review before confirming any Booking. FindPlay acts as a marketplace facilitator and will process refunds or credits in accordance with the applicable Cancellation Policy.
Play Providers must establish and clearly communicate their Cancellation Policy within each Listing. Available cancellation frameworks include:
Flexible: Full refund if cancelled within a specified notice period (e.g., 24 hours before the Service).
Moderate: Partial refund if cancelled after the full refund period but within a secondary window.
Strict: No refund after a specified deadline.
Non-Refundable: No refunds under any circumstances once the Booking is confirmed.
Credit-Based: Credit issued for future Bookings in lieu of a monetary refund.
Rescheduling Allowed: Players may reschedule without penalty within the notice period.
Custom: Play Provider-defined policy with specific terms disclosed in the Listing.
The following circumstances may constitute valid grounds for cancellation, regardless of the Play Provider's Cancellation Policy. The burden of proof rests with the User requesting cancellation:
The Play Provider has materially failed to meet the obligations described in their Listing
Weather conditions are unsafe for the activity, as determined by industry best practice or relevant authority guidelines
Health or injury preventing participation, supported by medical documentation
Pregnancy-related accommodations or disability considerations, with appropriate documentation
Bereavement (death of a family member or member of the booking party)
Jury duty, compulsory military service, or unavoidable professional obligations with supporting documentation
Significant travel disruptions beyond the User's control (e.g., flight cancellations, natural disasters affecting travel routes)
Force Majeure Events
A cancellation will not be approved where the Listing details were clear and accurate and the Player simply changed their mind.
If a Play Provider cancels a confirmed Booking:
The Player will receive a full refund
FindPlay may impose penalties on the Play Provider, including reduced visibility, cancellation fees, or account restrictions
FindPlay may assist the Player in finding an alternative Service where possible
Play Providers should not cancel confirmed Bookings except for valid reasons, including Force Majeure Events, safety concerns, or failure of the Player to meet prerequisites.
FindPlay Service Fees are generally non-refundable, even when the Play Provider offers a full refund, unless otherwise stated in the specific Cancellation Policy or at FindPlay's sole discretion.
FindPlay reserves the right, but is not obligated, to intervene in cancellation and refund disputes on a case-by-case basis. Where FindPlay intervenes, its determination is final, subject to the User's rights under applicable consumer protection laws.
If you initiate a chargeback or payment dispute with your financial institution for a legitimate Platform transaction, FindPlay reserves the right to suspend your account pending investigation, recover any amounts owed, and take appropriate legal action if the chargeback is found to be unwarranted.
A "No-Show" occurs when a Player fails to attend a confirmed Booking without cancelling in advance in accordance with the applicable Cancellation Policy. The following terms apply to No-Shows:
(a) Players who fail to attend a confirmed Booking without providing advance notice of cancellation are generally not entitled to a refund. The Play Provider's Cancellation Policy governs whether any refund or credit is available for No-Shows;
(b) Play Providers may set their own No-Show policies, which must be clearly disclosed in their Listing. These may include full forfeiture of the Booking fee, partial refunds, or the issuance of credits for future use;
(c) Where a Play Provider's Listing does not specify a No-Show policy, the default policy is that No-Shows are treated as late cancellations under the applicable Cancellation Policy framework;
(d) Players who experience a genuine emergency preventing attendance (such as medical emergencies, accidents, or similar unforeseen circumstances) may request a review by contacting support@findplay.com with supporting documentation. FindPlay may, at its sole discretion, issue a credit or facilitate a partial refund in such cases;
(e) Repeated No-Shows may result in account restrictions, including temporary suspension of booking privileges, reduced trustworthiness scores, or permanent account suspension for persistent abuse;
(f) Play Providers are encouraged to mark No-Shows through the Platform within 24 hours of the scheduled Service time to ensure accurate records and facilitate any applicable dispute resolution.
All Users must:
Act honestly, respectfully, and in good faith in all interactions
Comply with all applicable laws, regulations, and industry standards
Comply with FindPlay's Community Standards, Code of Conduct, and Positive Play principles
Respect the rights, safety, and dignity of all other Users
Use the Platform only for its intended purposes
Users must not:
Provide false, inaccurate, or misleading information
Engage in fraud, deception, or misrepresentation
Harass, bully, discriminate against, or threaten any User
Post or transmit harmful, offensive, defamatory, or obscene content
Use the Platform for any unlawful purpose
Circumvent or manipulate Platform fees, billing, or payment systems
Attempt to conduct transactions outside the Platform to avoid fees
Scrape, harvest, or collect data from the Platform without authorization
Introduce viruses, malware, or any other harmful code
Interfere with or disrupt the Platform or its infrastructure
Impersonate any person or entity
Use automated tools (bots, scripts) to access the Platform without authorization
Spam other Users or engage in unsolicited commercial communications
Manipulate reviews, ratings, or search results
Violate the intellectual property rights of FindPlay or any third party
Use the Platform to promote competing platforms or divert Users away from FindPlay
Play Providers are solely responsible for identifying and complying with all laws, regulations, permits, licenses, and insurance requirements applicable to the Services they offer. This includes but is not limited to consumer protection laws, health and safety regulations, employment laws, insurance requirements, and anti-discrimination laws. FindPlay provides some guidance in our Help Center, but this does not constitute legal advice.
FindPlay strongly recommends that all Users maintain appropriate insurance coverage for their activities on the Platform. Play Providers offering Services should obtain adequate public liability insurance, professional indemnity insurance, and any other insurance required by law or industry standards. Players should consider personal accident or travel insurance. FindPlay does not provide insurance coverage to Users and is not responsible for any User's failure to obtain adequate insurance.
Users must not, directly or indirectly:
(a) Solicit or encourage other Users to complete transactions outside the Platform to avoid Service Fees or Commissions;
(b) Share personal contact details (including email, phone number, social media handles, or website URLs) with the intent of diverting transactions off-platform, prior to a Booking being confirmed;
(c) Use information obtained through the Platform to contact other Users for off-platform transactions;
(d) Offer or accept discounts or incentives conditioned on completing transactions outside the Platform.
FindPlay may monitor for signs of circumvention using automated detection systems. Violations may result in fees equivalent to the Service Fees that would have been payable, suspension or termination of your account, and forfeiture of any outstanding Payouts.
FindPlay is committed to fostering an inclusive and welcoming environment for all Users. Discrimination has no place in play. All Users must comply with the following:
(a) Users must not discriminate against any other User on the basis of race, color, ethnicity, national origin, citizenship, immigration status, religion, sex, gender, gender identity, gender expression, sexual orientation, marital status, disability, medical condition, age, pregnancy, veteran status, socioeconomic status, political opinion, or any other characteristic protected by applicable federal, state, local, or international law;
(b) Play Providers must not refuse service, impose different terms, or treat Players differently based on any protected characteristic, except where a legitimate and lawful reason exists (such as age restrictions for safety, skill-level prerequisites for competitive activities, or gender-specific programs where permitted by law);
(c) Users must not post Content, Listings, reviews, or communications that express, promote, or incite hatred, prejudice, or discrimination against any individual or group based on protected characteristics;
(d) FindPlay supports adaptive and inclusive play and encourages Play Providers to make reasonable accommodations for participants with disabilities, in accordance with the Americans with Disabilities Act (ADA), the Disability Discrimination Act 1992 (Cth) in Australia, and equivalent legislation in other jurisdictions;
(e) Any User who believes they have been subjected to discrimination on the Platform may report the incident to support@findplay.com. FindPlay will investigate reported incidents and may take action including content removal, warnings, account suspension, or permanent banning of Users found to have engaged in discriminatory conduct;
(f) FindPlay reserves the right to remove any Listing, Content, or User account that violates this Anti-Discrimination Policy, without prior notice where the violation is severe or poses an immediate risk to the safety or dignity of other Users.
FindPlay maintains a separate Code of Conduct and Safety-First Guidelines document ("Code of Conduct") that establishes the behavioural standards, fair play expectations, and safety-first principles that all Users must observe when using the Platform and participating in Services. The Code of Conduct is available at [Insert Code of Conduct URL] and is incorporated into these Terms by reference.
The Code of Conduct applies to all Users in all interactions facilitated through or arising from the Platform, including:
(a) All in-person interactions during Services booked through the Platform, including activities, coaching sessions, events, competitions, and venue visits;
(b) All digital interactions conducted through the Platform's communication tools, including messages, reviews, comments, and community forums;
(c) All interactions between Users that arise from connections made through the Platform, even if those interactions occur outside the Platform;
(d) The conduct of Play Providers in the delivery of their Services, including their treatment of Players, participants, spectators, and other Users;
(e) The conduct of Players and participants before, during, and after Services, including their treatment of Play Providers, fellow participants, and venue property.
The Code of Conduct establishes fair play principles that all Users are expected to uphold, including but not limited to:
(a) Treating all participants, officials, coaches, spectators, and opponents with dignity and respect, regardless of the outcome of any activity or competition;
(b) Competing and participating honestly, without cheating, intentional rule-breaking, or unsportsmanlike conduct;
(c) Respecting the decisions of officials, referees, umpires, and other Game Officials, and using established channels (not abuse or intimidation) to raise concerns;
(d) Encouraging and supporting fellow participants, particularly beginners, young people, and those returning to activity after absence or injury;
(e) Refraining from abusive language, aggressive behaviour, bullying, or intimidation, whether directed at other participants, officials, coaches, spectators, or any other person;
(f) Respecting the rules and spirit of the activity, the venue, and the community.
All Users share responsibility for maintaining safe environments. The Code of Conduct establishes the following safety-first principles:
(a) Play Providers must prioritise participant safety above all other considerations, including commercial interests. This includes maintaining safe environments, providing appropriate supervision, ensuring equipment is safe and fit for purpose, and responding promptly to safety concerns or incidents. Play Providers must have and communicate clear emergency procedures for their Services;
(b) Players and participants must take reasonable steps to protect their own safety and the safety of others, including following safety instructions, disclosing relevant health conditions or limitations to Play Providers before participating, using equipment as directed, and reporting hazards or unsafe conditions;
(c) All Users must report any safety incident, near-miss, injury, or unsafe condition that occurs during or in connection with a Service to the Play Provider immediately and to FindPlay at safety@findplay.com as soon as practicable;
(d) Where a conflict exists between continuing an activity and participant safety, safety must always take priority. Play Providers have the right and the obligation to pause, modify, or cancel any Service where they reasonably believe continuing poses a risk to participant safety;
(e) Play Providers offering Services involving minors must apply heightened safety standards, including ensuring appropriate adult-to-child supervision ratios, maintaining current child safety clearances, and implementing child-safe practices in accordance with applicable law and industry best practice.
The Code of Conduct includes guidance on preventing and resolving disputes between Users, including:
(a) Prevention: Setting clear expectations through accurate Listings, transparent communication, prompt responses to questions, and proactive disclosure of any issues or changes that may affect a Booking or Service;
(b) Direct resolution: Encouraging Users to resolve disagreements directly, respectfully, and in good faith before escalating to FindPlay. The Code of Conduct provides practical guidance on how to raise concerns constructively and reach mutually acceptable outcomes;
(c) Platform-assisted resolution: Where direct resolution is not possible, Users may use the Platform's dispute resolution tools or contact support@findplay.com for assistance, in accordance with Section 14 of these Terms;
(d) Behavioural expectations during disputes: Users must remain respectful and proportionate during disputes. Retaliatory reviews, harassment, threats, or intimidation in response to a legitimate complaint or dispute are serious breaches of the Code of Conduct and these Terms.
Breaches of the Code of Conduct are treated as breaches of these Terms. FindPlay may take enforcement action proportionate to the severity of the breach, including:
(a) Issuing formal warnings;
(b) Requiring the User to complete additional training or acknowledgement of standards;
(c) Temporarily restricting specific Platform features (such as messaging or review capabilities);
(d) Suspending the User's account for a defined period;
(e) Permanently terminating the User's account;
(f) Reporting the conduct to relevant authorities where required by law or where the safety of any person is at risk.
FindPlay will endeavour to investigate reported breaches fairly and within a reasonable timeframe. Users accused of breaches will generally be given an opportunity to respond before enforcement action is taken, except where immediate action is necessary to protect the safety of Users or the integrity of the Platform.
FindPlay may update the Code of Conduct from time to time. Material changes will be communicated to Users in accordance with Section 1.3 of these Terms. Continued use of the Platform following notification of changes constitutes acceptance of the updated Code of Conduct.
You retain ownership of any User Content you submit to the Platform. By submitting User Content, you grant FindPlay a non-exclusive, worldwide, royalty-free, perpetual (for the duration the Content remains on the Platform and a reasonable period thereafter for archival purposes), sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content solely in connection with operating, promoting, and improving the Platform and our business.
You represent and warrant that:
You own or have the necessary rights to submit the User Content
The User Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party
The User Content is accurate, truthful, and not misleading
The User Content complies with these Terms and all applicable laws
All User Content must:
Be related to sports, fitness, recreation, health, and play
Be appropriate for all ages
Be respectful and constructive
Not contain hate speech, bullying, discrimination, or any form of disrespect
Not contain sexually explicit, violent, or graphic material
Not promote illegal activities or dangerous behavior
Not contain personal information of third parties without their consent
All imagery, photographs, videos, and other visual media uploaded to the Platform (including Listing images, profile photos, event media, and promotional content) must comply with the following standards:
(a) Visual content must be relevant to the Listing, Service, profile, or activity it accompanies and must accurately represent the experience, venue, equipment, or individual depicted;
(b) Images and videos must be of reasonable quality, properly oriented, and clearly visible. Heavily pixelated, distorted, or misleading visuals may be removed;
(c) Visual content must be owned by the User or used with the express permission of the rights holder. Users must have obtained consent from any identifiable individuals depicted in photos or videos, including written consent from parents or guardians for images of minors;
(d) FindPlay may resize, crop, compress, or reformat visual content for display purposes across different devices and formats without altering the substance of the content.
The following visual content is strictly prohibited on the Platform:
Nudity, sexually suggestive, or explicit imagery or video of any kind
Content depicting or glorifying violence, injury, dangerous behavior, or illegal activity
Content that is racially, culturally, or ethnically discriminatory, offensive, or demeaning
Content containing hate symbols, slurs (whether textual or graphic), or imagery associated with extremist groups or ideologies
Images or videos that harass, bully, shame, or ridicule any individual or group
Misleading or deceptive imagery, including heavily altered or AI-generated images that misrepresent the actual Service, venue, instructor, or experience
Stock photos or generic imagery used to misrepresent a Listing as showing the actual Service, venue, or personnel (unless clearly disclosed as illustrative)
Content that infringes copyright, trademarks, or other intellectual property rights of any third party
Images or videos of minors that are exploitative, inappropriate, or uploaded without parental or guardian consent
FindPlay recommends the following best practices for visual content:
Use high-resolution, well-lit photographs that authentically represent your Service, venue, or activity
Include diverse representation of participants where possible to reflect the inclusive nature of play
Avoid excessive text overlays on images; Listing details should be conveyed through the Listing description fields rather than embedded in imagery
Ensure faces are clearly visible in profile photos (for individual accounts) or that logos are clear and professional (for organizational accounts)
For venue Listings, include recent photographs that accurately depict current facilities, amenities, and condition
For coaching and instructional Listings, include images that demonstrate the coaching environment and style
FindPlay reserves the right to review, moderate, and remove any visual content that violates these standards, using both automated systems and human review. Repeated violations of visual content standards may result in account warnings, restriction of upload capabilities, or account suspension. Users may appeal content moderation decisions by contacting support@findplay.com.
Users may leave reviews and ratings based on their genuine personal experience. Reviews must be accurate, truthful, respectful, and relevant to the Service being reviewed. Reviews must not contain personal attacks, hate speech, spam, or promotional content for competing businesses. FindPlay does not verify reviews for accuracy. Reviews represent the opinions of individual Users and do not reflect FindPlay's views.
FindPlay reserves the right to review, moderate, edit, or remove any User Content at its discretion, including through automated systems. FindPlay does not guarantee the accuracy of automated content moderation and is not liable for actions taken by automated systems. Users may appeal content moderation decisions by contacting support@findplay.com.
All Content on the Platform that is not User Content, including but not limited to text, graphics, logos, icons, images, software, data compilations, algorithms, and the overall design and arrangement of the Platform, is owned by FindPlay or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not use, reproduce, modify, distribute, or create derivative works of FindPlay's Content without express written permission.
If you believe that Content on the Platform infringes your copyright, please submit a notice to our designated copyright agent at legal@findplay.com containing: identification of the copyrighted work, identification of the infringing material, your contact information, a statement of good faith belief, and a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner, in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512).
Your privacy is important to us. Our collection, use, storage, and disclosure of personal information is governed by our Privacy Policy, available at [Insert Privacy Policy URL]. By using the Platform, you consent to the practices described in the Privacy Policy.
FindPlay collects and processes personal data as described in our Privacy Policy, including information you provide directly, information generated through your use of the Platform, information from third-party integrations (e.g., health and fitness wearables), and information from payment processing. We process this data to provide and improve the Platform, facilitate transactions, personalize your experience, communicate with you, and comply with legal obligations.
FindPlay implements reasonable technical and organizational measures to protect personal data from unauthorized access, alteration, disclosure, or destruction. These measures include but are not limited to encryption, access controls, regular security assessments, and incident response procedures.
(a) FindPlay offers optional integration with third-party health and fitness platforms and wearable devices, including Apple Health, Google Health Connect, Garmin Connect, Fitbit, and others ("Health Integrations"). These integrations are entirely optional and require your explicit consent before any data is accessed;
(b) Data obtained through Health Integrations is classified as sensitive personal information and subject to enhanced protections under applicable law, including state privacy laws that classify health data as sensitive (such as the CCPA/CPRA in California, the VCDPA in Virginia, and equivalent laws in other states);
(c) Health data collected through these integrations will only be used for the purposes disclosed at the time of consent, which may include personalized activity recommendations, performance tracking, injury prevention insights, and coaching analytics;
(d) FindPlay will not sell Health Data to third parties, use Health Data for advertising purposes, or share Health Data with insurers, employers, or other third parties without your explicit consent, except where required by law;
(e) You may revoke access to Health Integrations at any time through your account settings. Upon revocation, FindPlay will cease collecting new data from the disconnected source. Previously collected data will be handled in accordance with our Privacy Policy and data retention schedule;
(f) FindPlay does not provide medical advice. Health and fitness data displayed on the Platform is for informational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment;
(g) FindPlay is not responsible for the accuracy of data received from third-party health platforms or wearable devices.
Organizations, Federations, and other enterprise Users who process personal data through the Platform may be required to enter into a separate Data Processing Agreement with FindPlay, in compliance with applicable data protection laws.
Users of FindPlay's data products are solely responsible for ensuring compliance with any applicable statutory, regulatory, data sovereignty, or compliance requirements in their jurisdiction. FindPlay stores and processes data in the United States and may transfer data to other jurisdictions as necessary to provide the Platform. Where such transfers are subject to data protection requirements (such as the GDPR for Users in the European Economic Area, or equivalent regulations), FindPlay will implement appropriate safeguards in compliance with applicable law.
FindPlay does not directly process or store payment card data. All payment card processing is handled by our Payment Provider (Stripe), which maintains PCI DSS compliance. To the extent that your activities on the Platform involve handling payment card data, you are responsible for maintaining your own PCI DSS compliance.
In the event of a data breach that is likely to result in harm to affected individuals, FindPlay will notify affected Users and relevant regulatory authorities in accordance with applicable data breach notification laws, including state breach notification laws in the United States (all 50 states maintain breach notification laws with varying requirements), the GDPR (where applicable), and other relevant regulations. FindPlay will use reasonable efforts to provide notification without unreasonable delay and in accordance with applicable legal timeframes.
FindPlay operates globally and is committed to complying with applicable data privacy laws in the jurisdictions in which it operates or serves Users, including but not limited to:
(a) United States: The California Consumer Privacy Act and California Privacy Rights Act (CCPA/CPRA), and all other applicable state privacy laws. Users in states with comprehensive privacy laws may have additional rights including the right to know, delete, correct, and opt out of the sale or sharing of personal information, as well as the right to opt out of automated decision-making and profiling. FindPlay will honor universal opt-out preference signals (such as Global Privacy Control) where required by applicable law;
(b) European Economic Area: The General Data Protection Regulation (GDPR), where applicable to Users in the EEA;
(c) United Kingdom: The UK General Data Protection Regulation and Data Protection Act 2018, where applicable;
(d) Australia: The Privacy Act 1988 (Cth), including the Australian Privacy Principles and the Notifiable Data Breaches scheme;
(e) Other Jurisdictions: Applicable data protection and privacy laws in other jurisdictions where FindPlay operates or serves Users.
Users' specific rights under applicable privacy laws are described in detail in our Privacy Policy. To exercise any rights available to you under applicable data privacy law, please contact privacy@findplay.com.
FindPlay complies with the Children's Online Privacy Protection Act (COPPA) and applicable state laws regarding children's data. FindPlay classifies data relating to children under 13 as sensitive personal information. FindPlay does not knowingly collect personal information from children under 13 without verifiable parental consent. For Users between 13 and 17, FindPlay applies heightened data protections as required by applicable law, including obtaining opt-in consent before processing their data for targeted advertising.
The FindPlay name, logo, brand, trademarks, trade names, service marks, and all associated intellectual property are owned exclusively by FindPlay. Nothing in these Terms grants you any right, title, or interest in FindPlay's intellectual property except the limited right to use the Platform in accordance with these Terms.
Subject to your compliance with these Terms, FindPlay grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal or internal business purposes. This license does not include the right to sublicense, sell, modify, reverse-engineer, decompile, or create derivative works of the Platform or any of its components.
Users retain ownership of their intellectual property, subject to the license granted in Section 9.1. FindPlay will not use User Content in a way that is inconsistent with the license granted.
Access to FindPlay's APIs and integration tools is subject to separate API Terms of Use. Unauthorized use of FindPlay's APIs is strictly prohibited.
If you provide FindPlay with feedback, suggestions, or ideas regarding the Platform, you grant FindPlay a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback without any obligation to you.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
FINDPLAY DOES NOT WARRANT THAT: (A) THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM THE PLATFORM WILL BE ACCURATE OR RELIABLE; (C) ANY CONTENT OR INFORMATION ON THE PLATFORM IS ACCURATE, COMPLETE, OR CURRENT; (D) ANY DEFECTS IN THE PLATFORM WILL BE CORRECTED; OR (E) AI FEATURES WILL PRODUCE ACCURATE, SUITABLE, OR SAFE RECOMMENDATIONS.
FINDPLAY DOES NOT ENDORSE ANY USER, SERVICE, LISTING, OR CONTENT ON THE PLATFORM. ANY OPINIONS, ADVICE, OR INFORMATION EXPRESSED BY USERS ARE SOLELY THEIR OWN.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINDPLAY (INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES) SHALL NOT BE LIABLE FOR:
Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, goodwill, use, data, or other intangible losses
Damages arising from your use of or inability to use the Platform
Damages arising from any interaction with other Users, whether online or offline
Damages arising from unauthorized access to your account or data
Damages arising from your reliance on AI Features, automated recommendations, or search results
FINDPLAY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO FINDPLAY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by applicable consumer protection legislation that cannot be excluded, restricted, or modified by agreement, including:
(a) In the United States, applicable federal and state consumer protection laws, including the Federal Trade Commission Act and state unfair and deceptive acts and practices (UDAP) statutes;
(b) In Australia, the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). To the extent that FindPlay is entitled to limit its liability under the Australian Consumer Law, FindPlay's liability is limited (at FindPlay's option) to: (i) in the case of services, re-supplying the services or paying the cost of having them re-supplied; or (ii) in the case of goods, replacing the goods, supplying equivalent goods, or paying the cost of replacement;
(c) In the European Economic Area, applicable consumer rights under EU consumer protection directives;
(d) In any other jurisdiction, applicable mandatory consumer protection laws that cannot be waived or limited by contract.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In such jurisdictions, FindPlay's liability shall be limited to the maximum extent permitted by applicable law.
You acknowledge that participation in sports, fitness, and recreational activities involves inherent risks including, but not limited to, risk of physical injury, illness, disability, and death. By using the Platform and participating in any Service, you voluntarily assume all risks arising from such participation. You are solely responsible for assessing your own physical fitness, understanding the risks involved, and ensuring that you have the appropriate skill level for any activity you undertake.
FindPlay is not responsible for the conduct, acts, or omissions of any User, whether online or offline. Users participate in activities at their own risk. FindPlay disclaims all liability for any injuries, damages, or losses sustained during activities booked through the Platform. FindPlay strongly advises that Users consult with a qualified medical professional before participating in any physical activity or fitness program.
The Platform may contain links to third-party websites, services, or content. FindPlay does not control, endorse, or assume responsibility for any third-party content. Your use of third-party services is at your own risk and subject to those third parties' terms and conditions.
Nothing on the Platform constitutes medical, legal, financial, fitness, or nutritional advice. Users should consult appropriate qualified professionals for specific advice related to their circumstances.
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless FindPlay, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:
Your access to or use of the Platform
Your breach of these Terms or any applicable law or regulation
Your User Content
Your interaction with any User, including any injury, loss, or damage of any kind
Your provision or receipt of Services through the Platform
Your violation of any third party's rights, including intellectual property, privacy, or publicity rights
Any tax obligations arising from your use of the Platform
This indemnification obligation survives the termination of these Terms and your use of the Platform. FindPlay reserves the right, at its own cost, to assume exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with FindPlay's defense of such claim.
FindPlay encourages Users to resolve disputes directly and in good faith. If a dispute arises between Users, FindPlay may (but is not obligated to) provide limited mediation assistance. FindPlay's involvement does not create any obligation or liability on FindPlay's part. FindPlay's determination, if provided, is final subject to Users' rights under applicable law.
If you have a dispute with FindPlay:
Step 1 – Contact Us: You must first attempt to resolve the dispute by contacting FindPlay at support@findplay.com or through the Platform's dispute resolution tools. FindPlay will endeavor to respond within 14 business days.
Step 2 – Mediation: If the dispute cannot be resolved through direct communication within 30 days, either party may refer the matter to mediation administered by JAMS or another mutually agreed mediation service. The costs of mediation will be shared equally unless otherwise agreed.
Step 3 – Arbitration or Litigation: If mediation fails to resolve the dispute within 60 days of referral, either party may pursue resolution through binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, or through the courts of the applicable jurisdiction as set out in Section 16.1. The arbitration shall be conducted in the English language and the arbitral award shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THE ENTIRETY OF THIS ARBITRATION PROVISION SHALL BE NULL AND VOID, AND THE DISPUTE SHALL BE RESOLVED IN COURT.
Any claim arising from or related to these Terms or the Platform must be commenced within one (1) year after the cause of action arose. Claims filed after this period are permanently barred, except where prohibited by applicable law.
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
FindPlay will use commercially reasonable efforts to maintain the availability and functionality of the Platform. However, FindPlay does not guarantee uninterrupted or error-free access. The Platform may be temporarily unavailable due to scheduled maintenance, emergency maintenance, system failures, Force Majeure Events, or other circumstances beyond our reasonable control.
FindPlay reserves the right to modify, update, suspend, or discontinue any feature or aspect of the Platform at any time, with or without notice. FindPlay will endeavor to provide reasonable advance notice of material changes that significantly impact Users' access to or use of the Platform.
FindPlay may offer beta or experimental features that are still under development. Beta features are provided "as is" and may be modified or discontinued at any time without notice. Use of beta features is at your own risk.
These Terms are governed by and construed in accordance with the laws of the State of [Insert State — e.g., Delaware] and applicable federal laws of the United States, without regard to conflict of law principles. Subject to the dispute resolution procedures in Section 14, you submit to the exclusive jurisdiction of the state and federal courts located in [Insert State/County], for any disputes not resolved through arbitration.
For Users located outside the United States, the following additional provisions apply:
(a) If you are located in Australia, nothing in these Terms limits your rights under the Australian Consumer Law, and disputes involving Australian Consumer Law rights may be brought in Australian courts;
(b) If you are located in the European Economic Area, nothing in these Terms limits your rights under applicable EU consumer protection law, and you may bring claims in the courts of your country of residence;
(c) If you are located in any other jurisdiction, nothing in these Terms limits any mandatory consumer protection rights available to you under the laws of your jurisdiction.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. FindPlay's failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
These Terms, together with the Privacy Policy, Community Standards, Code of Conduct, and any applicable additional terms, constitute the entire agreement between you and FindPlay regarding the use of the Platform, and supersede all prior agreements and understandings, whether oral or written.
You may not assign or transfer these Terms or your rights hereunder without FindPlay's prior written consent. FindPlay may assign these Terms in whole or in part without restriction, including in connection with a merger, acquisition, or sale of assets.
Neither party shall be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay is caused by a Force Majeure Event. The affected party must provide notice as soon as reasonably practicable and use reasonable efforts to mitigate the effects of the Force Majeure Event.
Where a Force Majeure Event affects multiple Bookings or Services simultaneously, FindPlay may implement blanket policies (such as automatic credits, extended cancellation windows, or modified refund procedures) applicable to all affected Bookings. These policies will be communicated through the Platform and will override individual Cancellation Policies for the duration of the Force Majeure Event.
Nothing in these Terms creates a partnership, joint venture, employment, franchise, or agency relationship between you and FindPlay. Neither party has authority to bind the other or incur obligations on the other's behalf.
These Terms do not confer any rights on any third party, except that FindPlay's affiliates and Payment Providers are intended third-party beneficiaries of the relevant provisions.
FindPlay may provide notices to you via email (to the address associated with your account), in-app notifications, or by posting on the Platform. You may provide notices to FindPlay at the contact details in Section 17. Notices are effective upon delivery (for email) or posting (for Platform notices).
Provisions relating to intellectual property, limitation of liability, indemnification, dispute resolution, payment obligations, confidentiality, and any other provision that by its nature should survive, will survive the termination or expiration of these Terms.
Headings are for convenience only and do not affect interpretation. References to "including" and similar expressions are not limiting. References to legislation include amendments and successor legislation. Where any term is defined within the context of any particular section, the defined meaning shall apply throughout these Terms unless another meaning is clearly indicated.
You agree that these Terms, any additional agreements entered into through the Platform, and any notices or communications provided through the Platform may be made electronically. You consent to receiving communications, agreements, documents, and notices from FindPlay electronically, including via email, in-app notifications, or Platform postings. Your electronic acceptance of these Terms (including by clicking "I Agree," "Accept," or similar buttons, or by continuing to use the Platform after receiving notice of updated Terms) constitutes a legally binding signature and agreement, equivalent to a handwritten signature, to the fullest extent permitted by law, including under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), the Uniform Electronic Transactions Act (UETA), and applicable international electronic transaction laws.

"Play Providers" (or "Providers") means Users who offer, create, or manage Services through the Platform.
"Listing" means any experience, activity, competition, venue, event, class, coaching session, course, job posting, fundraiser, equipment rental, or other offering published on the Platform.
"Micro-Marketplace" means a white-label or custom-branded marketplace created by a Play Provider using FindPlay's marketplace building tools, which may be identified by the "Powered by FindPlay" designation.
"Payment Provider" means third-party payment processing services, currently Stripe, used to facilitate transactions on the Platform.
"Players" (or "Guests") means Users who discover, book, or participate in Services through the Platform.
"Platform" means FindPlay's websites, mobile applications, APIs, widgets, and all related technology, tools, and services.
"Play Type" means a category of sports, fitness, or recreational activity available on the Platform.
"Service" means any activity, event, venue booking, coaching session, course, or other offering facilitated through the Platform.
"Service Fee" means the fee charged by FindPlay for facilitating transactions or providing access to the Platform.
"Subscription" means a recurring payment arrangement granting access to premium features or enhanced Platform capabilities.
"Unclaimed Profile" means a preliminary profile for a sports or fitness provider created by FindPlay using publicly available information, prior to the provider claiming and verifying the profile.
"User Content" means any Content submitted, posted, or transmitted by Users through the Platform.
